Crocker I MORAL PHILOSOPHY has languished long within the confines of something like the following purported dilemma: either moral discourse is the discourse of principles and rules rationally grounded, or moral discourse is the discourse of passions and personal preferences, clothed in the garments of rational justification. Alasdair (...) MacIntyre's disquieting suggestion—that our language of moral debate is nothing more than the "simulacra of morality"—provides a grim outlook for moral philosophy. 1 Indeed, when moral inquiry is conducted in terms of ethical theory, without independent grounds upon which competing arguments can meet, philosophical discourse, embedded in competing theories, seems to be only so much cacophonous clamor, rationally convincing no one except those who already accept the terms employed by their own theory. One way to avoid this philosophical effluvium produced by moral philosophy is to follow Ludwig Wittgenstein in rejecting the very terms upon which it is made (the distinction between the particular perspective and the universal standpoint), recognizing that moral inquiry begins from where we already are—the everyday world in which we find ourselves.Towards the end of avoidance here, I wish to add to this simmering background of ethical discord Mark Twain's story of The Adventures of Huckleberry Finn. 2 Twain's controversial voice provides a place for moral thinking unavailable through strictly theoretical discourse. 3 And reading Huck and Jim's story through the philosophical avoidance of Wittgenstein's latent ethical thought provides the transformative possibility of seeing the domain of the ethical in a new light. 4 [End Page 57]Although Twain boldly states at the beginning of his novel that "persons attempting to find a moral in it will be banished," 5 he does show us without the need of theory or dogma how a change in one's way of seeing is intertwined with a change in one's way of living; this connection between ways of seeing and ways of living makes possible a kind of moral transformation that characterizes the change in Huck's perception of Jim, from that of a slave to that of a friend. This moral conversion is much like the perceptual transformations that Ludwig Wittgenstein considers in his discussions of "noticing an aspect," 6 in which a shift in what one sees is connected to the background against which the perceptual object is seen and to the ways in which one is prepared to respond to it. When confronting perceptual ambiguity, as in the case of Jastrow's ambiguous duck/rabbit figure, one looks to the context and background to clarify what one sees, just as one does with semantic ambiguity. In coming to see in one way or the other, nothing is explicitly stated, nothing is put into argumentative form. And in Twain's narrative, we are not given arguments for why we should see Jim as human, nor does the narrative recount Huck's confrontations with moral arguments; rather, through his interactions with Jim, Huck is shown Jim's humanity, his friendship, and we, the readers, are shown the possibility of a moral transformation that is not determined by or grounded in rules or philosophical arguments.The moral realist might agree that such a transformation could be motivated in ways other than rational arguments, but to be legitimate, it must be possible to reconstruct the transformation according to rational considerations. The ability to "get behind" the transformation in some justificatory way is what I am denying here (as is Wittgenstein); for what one finds when one "gets behind" is another situated language game that is itself not open to question (though it could be if we direct our attention towards it). There is no final "getting behind" the things we do and the situations in which we do them, and hence there is no final justificatory argument one can give—as Wittgenstein famously says, "If I have exhausted the justifications I have reached bedrock, and my spade is turned. This book contains the text of Thomas Kuhn's unfinished book, The Plurality of Worlds: An Evolutionary Theory of Scientific Development, which Kuhn himself described as "a return to the central claims of The Structure of Scientific Revolutions, and the problems that it raised but did not resolve." The Plurality of Worlds is preceded by two related texts that Kuhn publicly delivered but never published in English: his paper "Scientific Knowledge as a Historical Product" and his Shearman Memorial Lectures, "The (...) Presence of Past Science." The book opens with an introduction by the editor that describes the origins and structure of The Plurality of Worlds, and sheds light on its central philosophical problems. Kuhn's aims in his last writings are bold. He sets out to develop an empirically grounded theory of meaning that would allow him to make sense of both the possibility of historical understanding and the inevitability of incommensurability between past and present science. Moreover, he intends to show that incommensurability is fully compatible with a robust notion of a real world that science investigates, with the rationality of scientific belief change, and with the idea that scientific development is progressive. The author's concept of incommensurability is explicated by elaborating the claim that some terms essential to the formulation of older theories defy translation into the language of more recent ones. Defense of this claim rests on the distinction between interpreting a theory in a later language and translating the theory into it. The former is both possible and essential, the latter neither. In this article several justifications of what I call ‘the claim from adoption’ are examined. The claim from adoption is that, instead of expending resources on bringing new children into the world using reproductive technology and then caring for these children, we ought to devote these resources to the adoption and care of existing destitute children.Arguments trading on the idea that resources should be directed to adoption instead of assisted reproduction because already existing people can benefit from such a use (...) of resources whereas we cannot benefit individuals by bringing them into existence are rejected. It is then argued that a utilitarian argument proposed by Christian Munthe that supports the claim from adoption in some situations should be rejected because the support it offers does not extend to certain situations in which it seems morally obvious that resources should be expended on adoption rather than assisted reproduction. A version of the Priority View improves upon Munthe’s utilitarianism by supporting the claim from adoption in the cases in which Munthe’s argument failed. Some allegedly counterintuitive implications of the Priority View are then discussed, and it is concluded that the Priority View is more plausible than utilitarianism.n a concluding section on policy issues it is argued that, even though the claim from adoption can be justified in a variety of situations, it does not follow that, in these situations, governments should direct resources away from assisted reproduction and towards adoption. HIBBS Boston College Chestnut Hill, Massachusetts IN A RECENT issue of The Thomist, J. A. DiNoia, O.P., argues that certain themes in post-modern thought provide an occasion for the recovery of neglected features of the Catholic tradition.1 DiNoia focuses on three motifs : first, a " broader conception of rationality," with an emphasis on the (...) " role of tradition and authority," second, attention to the " role of texts and narrative in shaping thought and culture," and, third, the " importance of community in fostering personal identity." These themes have been prominent in the writings of Alasdair Macintyre. In his latest publication, Three Rival Versions of Moral Enquiry, he brings the Augustinian-Thomistic tradition into conversation with its principal rivals, encyclopaedia and genealogy.2 The dialogical character of the work, the text of his Gifford Lectures, affords Macintyre the opportunity to sharpen and develop his views of rationality, of the connection between particularism and universalism, and of the Christian contribution to moral inquiry. As they see it, " Either reason is thus impersonal, universal, and disinterested or it is the unwitting representative of particular interests, masking their drive to power by its false pretensions to neutrality and disinterestedness." But the mutually exclusive way of putting the question conceals a third possibility, the possibility that reason can only move towards being genuinely universal and impersonal insofar as it is neither neutral nor disinterested, that membership in a particular type of moral community, one from which fundamental dissent has to be excluded, is a condition for genuinely rational inquiry.3 The passage introduces the salient features of Macintyre's view of the relationship between particularism and universalism.4 Macintyre develops his view not only in confrontation with genealogy and encyclopaedia, but also out of the Thomistic tradition. In a chapter entitled, "Too Many Thomisms? ", Macintyre describes the history of the revival of Thomism after Aeterni Patris.5 Macintyre criticizes early neo-Thomism for reading Aquinas as a systematic thinker, whose project was fundamentally epistemological. In most parts of the world, the doping debate is characterised by an extreme tunnel vision since all athletes, politicians and sports managers who have public airtime express that doping is bad or the invention of the devil. -/- The purpose of 'Doping in Sport: A Defence' is to identify, clarify and challenge some of the central arguments that are used in (...) the often extremely emotional debate that primarily focuses on rejecting the use of doping. I hope that my effort to clarify and challenge the arguments will help cultivate a productive dialogue where all arguments are given a fair trial instead of the prevailing one-sided condemnation of doping. An open dialogue about doping is important since the question of where the line should be drawn when it comes to doping in sports is highly relevant in terms of the scope within which athletes, sports physicians, sports managers, coaches and pharmaceutical companies can operate in the world of sports. The aim of this article is to provide a systematic reconstruction and critique of what is taken to be a central ethical concern against the use of non-medical egg freezing. The concern can be captured in what we can call the individualisation argument. The argument states, very roughly, that women should not use NMEF as it is an individualistic and morally problematic solution to the social problems that women face, for instance, in the labour market. Instead of allowing or expecting (...) women to deal with them on an individual level, we should address them by challenging the patriarchal structures of the labour market—for example, by securing equal pay, or paid maternal leave, or ‘paid paternal [partner] leave and sick leave and affordable child care’. It will be made clear that there are several versions of this argument. The author will try to elaborate this claim, and it will be explained that the differences depend on the way in which bioethicists believe that individuals use of NMEF is morally problematic, compared with the alternative of securing social change for women in, say, the labour market. Finally, a critical discussion of three versions of the individualisation argument will follow, and it will be shown why all versions are on rather thin ice, or in other words, that they are implausible. The case is very interesting as the patient was rather disoriented when waking up from an artificial coma of several weeks, and (...) it took her many years to fully recover. The goal of this paper is to describe some aspects of this process from a subjective perspective as well as from a participant observer’s viewpoint. The data used for this chapter mainly stem from in-depth qualitative interviews. The structures of the life-world of Alfred Schutz are used to analyze the processes of sense constitution. The aim of this critical commentary is to distinguish and analytically discuss some important variations in which legal moralism is defined in the literature. As such, the aim is not to evaluate the most plausible version of legal moralism, but to find the most plausible definition of legal moralism. As a theory of criminalization, i.e. a theory that aims to justify the criminal law we should retain, legal moralism can be, and has been, defined as follows: the immorality of an (...) act of type A is a sufficient reason for the criminalization of A, even if A does not cause someone to be harmed. In what follows, I critically examine some of the key definitions and proposals that have, unfortunately, not always been carefully distinguished. Finally, I propose a definition that seems to capture the essence of what many philosophers refer to when they talk about legal moralism, while also providing more clarity. (shrink)
